陈若剑律师是段和段（北京）律师事务所的管理合伙人、国际争议解决部负责人。陈若剑律师毕业于中国政法大学和复旦大学，先后获法学双学士和法律硕士学位。陈若剑律师于2001年加入段和段律师事务所并取得中国律师执业执照。工作语言为中文和英文。

1.跨境争议解决：陈律师在国际仲裁和诉讼领域拥有10多年的丰富经验和诸多胜诉案例，曾参与代理众多中国国有大型企业和民营企业在中国国际经济贸易仲裁委员 会、香港国际仲裁中心、国际仲裁院、新加坡国际仲裁中心、美国联邦法院及香港高等法院等处理商业争议案件（包括金融、并购、能源、建筑、股东纠纷等）。陈律师参与代理的中路实业与美国BRUNSWICK的国际仲裁，成功帮助中路实业避免了高达一亿美元的索赔。
2. 国际投资和融资：陈律师曾担任多家中国企业的海外投融资法律顾问，为中国进出口银行、新星石油、长联石油、安泰瑞石油、中海油、上海实业、中路集团、长城医学会等提供海外投资法律服务。陈律师还参与代理多家外国知名企业在华投资法律事务，包括国际管理集团（IMG）、耐克、Monsanto、 Groupon、甲骨文、奥雅纳、三菱商社、日清食品、吴羽化工、英德拉等。陈律师还全程参与了上海市政府与美国迪斯尼公司就上海建立迪斯尼主题公园的谈判和文件起草工作。
3.知识产权保护：陈律师参与了美国苹果公司与深圳唯冠之间的 “IPAD”商标纠纷，担任债权人银行和“IPAD”商标查封人的律师。陈律师还曾代理美国NIKE、GROUPON、可口可乐、LEUPOLD、 MONSANTO、英国ARUP（奥运鸟巢和水立方的设计公司）处理知识产权法律业务。陈律师成功处理的ARUP被假冒商标案件得到了英国驻华大使馆的好评，并被列为公安部督办的知名产权保护案件。陈律师就该类假冒外国代表处从事诈骗活动的法律制度缺陷上书国家工商总局，促成了1983年发布的《关于外国企业常驻代表机构登记管理办法》被废止和修订，推动了外商投资和知识产权保护立法进程。
4.金融法律领域：陈律师曾作为中国进出口银行上海分行、星展银行等多家金融机构的法律顾问，就各项银行法律业务提供法律意见。陈律师主理了东方海外就天津房地产项目向星展银行、中国银行、华一银行、大众银行、大新银行等借贷的金额为人民币18亿元的人民币银团贷款项目，还主理了中国进出口银行上海分行与海南航空的多架波音飞机融资项目。陈律师曾常驻金融混业上市公司——爱建股份有限公司近一年时间，全程处理爱建股份下属信托公司、证券公司、香港资产、哈尔滨资产、长沙资产等金额达30多亿元的复杂、综合性法律业务，妥善处理了上百家企业和个人的诉讼和索赔。
5.海关法律领域：陈律师在该法律领域居于领先水平，先后代理多家跨国公司包括耐克、可口可乐、固特异、天纳克等处理与海关归类争议、免税优惠、海关监管有关的海关调查、行政诉讼和走私案件。在处理某美国公司在华涉嫌走私普通货物罪的调查程序中，成功地将归类争议焦点提交给世界海关组织（WCO），开辟了就此类争议成功诉诸国际机构的先例。

发表文章和书籍：

Working experience: 
Oscar Chen joined in Duan & Duan and was admitted to practice in 2001. Oscar Chen is the managing partner of Duan & Duan Beijing office while being the head of Cross-border Dispute Resolution Department of Duan & Duan. He can speak and write fluent Chinese and English. Mr. Chen got his LLB from China University of Political Science and Law (CUPL) and got his LLM from Fudan University.

Professional Background:

1. Cross-border Dispute Resolution: Mr. Chen has extensive experience and expertise in the field cross-border dispute resolution and a fierce litigator. Mr. Chen has advised on numerous cases involving disputes related to financial matters, M&A, energy and real estate, etc. He also represented many cases involving shareholder’s dispute and other cause of action at the China International Economic and Trade Arbitration Commission (CIETAC), the Hong Kong International Arbitration Center (HKIAC), the International Court of Arbitration (ICC), the Singapore International Arbitration Centre (SAIC), the U.S. Federal Court or the Hong Kong High Court. Mr. Chen worked on different matters whether involving stated-owned enterprises (SOE) or private enterprises. He also represented Zhong Lu in an international arbitration matter in connection with a claim for compensa-tion for losses against Zhong Lu in the amount of USD 100,000,000.
2. International investment and project financing: Mr. Chen actively represented a number of domestic enterprises in connection with overseas investments. His clients include: China Export & Import Bank, Sinopec New Star Oil, Great United Petroleum Holding Co. Ltd (GUPC), An Rui Tai Petroleum, CNOOC, Shanghai Industrial Investment (Holding) Co. Ltd., Zhong Lu Bowling, Great Wall Medical Committee and more. In addition, he represented a number of international enter-prises in connection with foreign direct investment transactions. His clients include: IMG, Nike, Monsanto, Groupon, Oracle, Arup, Mitsubishi Corporation, Nissin Foods, Kureha, Indra and more. He also played an active role in the negotiation and in the drafting of the transactional documents between the Shanghai Municipal Government and the Walt Disney Company with regards to the build-ing of the Disney theme park in Shanghai.
3. Intellectual Property: Mr. Chen represented the crediting bank in the “IPAD” trademark seizure in connection with the famous “IPAD” trademark dispute in between Apple and Proview. He also represented international well-known com-panies like NIKE, GROUPON, COCACOLA, LEUPOLD, MONSANTO, ARUP in connection with intellectual property matters in China. His victory in the case of the ARUP trademark counterfeiting even attracted the attention of the UK Embassy and became a famous case of Chinese Central Police Bureau within this area. Finally, Mr. Chen’s letter to the state administration for industry and com-merce (AIC) regarding the current issues in the Chinese legal system, mainly per-taining to fraudulent of “fake” foreign rep-office in China, was instrumental to the reform and amendment of the 1983 Act on the Administration of Registration of Representative Office of Foreign Enterprises in China.
4. Financing: Mr. Chen represented the Shanghai Branch of China Export & Import Bank and DBS acting as their legal counsel in various financing transactions. Mr. Chen advised DBS Bank, China Bank, Sino Bank, Popular Bank, Bah Sing Bank in connection a syndicated loan of 18 billion RMB for the financing of a real es-tate project in Tianjin. He advised China Export & Import Bank and Hainan Air-lines in connection with the financing for the Boeing Airplanes project. He also acted as legal counselor for Ai Jian Co. Ltd, a listed financial institution with re-gards to a complex transaction totalizing RMB 30 billion and involving trust company, Securities Company, asset in Hong Kong, Changsha and Harbin. He also represented Ai Jian in the hundreds cases initiated by enterprises and indi-viduals in connection with litigation matters often involving claims for compensa-tion against Ai Jian Co.
5. Customs: Oscar Chen is one of the leading lawyer within this area having represented many international companies, which include Nike, Coca-Cola, Goo-dyear, Tenneco in connection with criminal custom investigation and administra-tive investigation matters pertaining to the crime of smuggling, concessions of duty-free and custom supervision. During an investigation targeting an American company which was suspected of having smuggled ordinary goods, Mr. Chen succeeded in defending his client’s rights by submitting materials which contra-dicted the World Customs Organization (WCO) Rulings.
