彭焰热爱生命、酷爱学习、博览群书，喜读世界名著、做读书笔记，在政法学院曾获书法、绘画三等奖，作诗填词、吹拉弹唱，情趣广泛。20世纪80年代中期，《中国律师》《法学研究》《法学杂志》《法学译丛》等法学刊物，在她微薄工资的支出中一本也不能少。这些专业刊物伴她一路走来为她专业发展、实务操作和学业升级提供了丰沛的养分和理论支撑。除法学本业外，对文学、政经、哲学、形式逻辑辩证逻辑、心理学、星相学、易学等方面知识有很浓厚的兴趣，同时对现实世界的政经人文等国际国内时事十分关注，并将这些知识和信息在工作、学习中善加融通应用，以使看待问题和判断事物更理性、更客观、更全面和准确。

彭焰的职业感言：彭焰律师的星座是天秤座。传说天秤座是古代罗马正义女神的化身阿斯拉雅女子手中所持的一杆称，公正的衡器。正如她的感言：“在中国社会力求摆脱几千年封建意识进入现代文明社会的历史进程，我们选择的律师职业，就像一个拓荒者，高挚公平正义的火炬穿越充满荆棘的历史森林，经纬百度伤痕斑驳，一如既往百折不挠，这就是我们的使命！”

Performance overview: She defended a severe crime of robbery and murder jointly notified by six states ministries and commissions, major gang crimes, murders and kidnappings, and other economic crimes in many provinces and cities, and got desirable results of acquittal or lenient sentence. She handled a serial fraud involving a huge contract amount across five provinces and six regions for a state-owned enterprise, and managed to retrieve the losses and prevent the enterprise from going bankrupt. She handled several major construction project cases, and won the cases because she was familiar with legal and construction expertise in bidding, quota calculation, budgeting, final settlement, etc. She conducted optimal design, splitting and reorganization, M&A or capital-equity replacement for Chinese investment by a number of transnational corporations (including Siemens and Toyota), realizing their investment objectives at low costs and risks. Over these years, she has provided whole-process legal services for foreign investment, M&A by foreign investors, overseas investment by Chinese investors, equity replacement, property transactions, foreign investors’ participation in state-owned enterprise reform, divestiture, staff reassignment, joint stock system reform, asset restructuring, and enterprise M&A, and foreign investors’ investment in the educational, medical, energy, hydropower and electricity sectors in western China, and managed to avoid any legal risk while balancing interests of all parties through legal framework design and procedure control. She provided whole-process legal services for the establishment of three independent schools of two universities, the acquisition and restructuring of a state-owned engineering hospital into an international modern hospital, the acquisition of two power stations, and the integrated development of a major project of the Dujiang Dam. She conducted legal framework design and protection for the development and promotion of energy, environmental protection and green circular economy projects through her personal planning, design and implementation. She has been providing effective legal assistance to vulnerable groups who have suffered great damages but are unable to get relieved, even at her own expense, thereby helping them build up confidence in rule by law, fairness and justice while protecting their lawful rights and interests. In handling major crimes in many provinces and cities, she has shown strong capabilities and practical skills in mitigating commercial, legal, social and political risks, protecting rights and maintaining stability. By handling many well-known major civil and commercial cases successfully, she has realized favorable effects in upholding social fairness and justice. She has been offering unofficial legal assistance to protect people’s rights.

From the moment she received the lawyer’s license, she realized her duties and obligations. She thinks that she is a law protector and a cleaner in the legal environment, and would do her best to pursue fair results and professional ethics in whatever case. It is this professional spirit of glory, courage and self-discipline that makes her always feel love and responsibility. Her career is filled up with successful cases, each of which reflects her dedication to the lawyer profession. She often feels that her life is led by the holy duties of a lawyer, and cares little about personal honors and interests. For over three decades of practice, she has been pursuing the eternal brilliance of law with a deep love for the profession. It is such pursuit that makes her devoted to her duties in protecting justice, order, peace and human rights. She always practices the philosophy of rule by law within the legal framework, and has handled a number of admirable cases, and contributed to industry development and legal system building with her own wisdom and power.

Peng Yan loves life and learning, likes to read world classics, take reading notes, write poems and lyrics, and play musical instruments, and once won calligraphy and painting prizes at the political science and law. In the mid 1980s, law journals like Chinese Lawyer, Chinese Journal of Law, Law Science Magazine and Law Translation were her must-reads despite of her slender salaries. These journals have helped her a lot in career development, and practical and academic upgrading. In addition to her own specialty, she is also strongly interested in literature, politics, economy, philosophy, formal logic, dialectical logic, psychology, astrology, Yi Jing studies, etc., and highly concerned about international and domestic current events. She has applied such knowledge and information to her work and study, enabling her to view and judge things more rationally, objectively, comprehensively and accurately.

Career feelings: Lawyer Peng’s constellation is Libra, which is said to be a scale – a fair weighing instrument – in the hands of Lady Justice Astraea in ancient Rome. As she felt, “In the historical process that Chinese society attempts to cast off thousand-year-old feudal ideology and become a modern civilized society, we lawyers are pathfinders who hold a torch of fairness and justice, and run through a historical forest full of thistles and thorns. Despite of countless wounds, we remain indomitable. This is just our mission!”

In my lawyer career that has lasted for decades, my love for the profession, and persistence for legal fairness and justice have never diminished. I have been defending the glory of the profession with my life, and honored my professional pledge as a CPC member. In spite of so many difficulties, I never regret my original choice. I will keep performing my duties in protecting justice, order, peace and human rights earnestly, and practicing the philosophy of rule by law within the legal framework.

I hope to make people know through our practicing experiences that there do be excellent lawyers with the DNA of freedom, equality, fairness and justice who have been devoting their efforts to human civilization and development.

As lawyers with the law spirit, we make every effort to protect fairness from powers, create a fair and just world for all people, and give everyone hope and confidence.

As a lawyer having worked at the forefront of practice and theory for decades, I’m often obsessed by in-depth profession thinking. I think that social fairness and justice must be realized by replacing the old legal system based on bureaucracy and citizenship with the philosophy of rule by law, driving the operation of the Constitution and laws with the highest values, developing a social atmosphere of law-ruled civilization gradually, guiding people to develop a sense of citizenship and responsibility, and build inherent connections with the country, and aligning the social psychology with the modern requirements of rule by law.

Lawyer Peng has always been working work law leisurely, happily, proficiently and purely, because her practicing faith has been integrated deeply into her lifelong pursuit and soul.

Peng Yan said, “If the life could be repeated, she would resume this profession of conscience and perform her holy duties extremely carefully!”
